Art. 1.
(1) These General Terms and Conditions govern the use of the website www.zographic.com (hereinafter referred to as the “Website”), administered by Zographic Films Ltd., with its registered office at 27 Svetoslav Terter St., Apt. 10, Sofia (hereinafter referred to as “Zographic Films”).
(2) By using the Website, users are deemed to have read, understood and accepted these General Terms and Conditions and undertake to comply with them.
(3) These General Terms and Conditions do not amend the terms of any other written agreement that third parties may have concluded with Zographic Films concerning the use of other products or services.
Art. 2.
(1) Zographic Films provides users with free access, for personal use, to all publicly available text, graphic, audio and video materials and other content published on the Website and developed by Zographic Films and/or its partners.
(2) Users may access and use the services provided through the Website for their own purposes, subject to the conditions and access requirements established by Zographic Films.
(3) Users are responsible for providing the technical equipment and internet connection necessary to access and use the Website.
(4) Users may access content published on the Website only for personal use and through the normal functionality of the Website.
(5) Users undertake not to access content published on the Website by means of technologies or methods other than those provided by the Website and available through its normal functionality.
(6) Users undertake not to use the Website for unlawful purposes and shall comply with all applicable local, national and international laws and regulations, including those relating to intellectual property.
Art. 3.
(1) The Website may contain links to third-party websites. Such links are provided solely for the convenience of users.
(2) Zographic Films does not endorse the content of third-party websites and shall not be responsible for their content or for any damage arising from a user’s access to or use of such websites.
Art. 4.
(1) The intellectual property rights in all elements of the Website, including its design, software, databases, texts, drawings, graphics, sketches and other information or materials, are protected under the Copyright and Related Rights Act and/or the Marks and Geographical Indications Act and are owned by Zographic Films and/or third parties that have granted Zographic Films the relevant rights of use. Such intellectual property may not be used in violation of applicable law.
(2) A user’s right to access the materials and resources available on the Website does not include the right to use, record, store, modify, adapt, publicly distribute, copy or reproduce such information, materials and resources, or otherwise use protected intellectual property, except for limited information intended for personal and non-commercial use, provided that the legitimate interests of the authors or other holders of intellectual property rights are not unduly prejudiced.
Users may not remove trademarks, copyright notices or other notices concerning intellectual property rights from any materials made available to them, irrespective of whether the relevant rights are held by Zographic Films, its partners, clients or other third parties.
Art. 5.
Zographic Films shall not be liable for:
Any interruptions or technical problems preventing or restricting the use of the Website that result from the user’s computer equipment, including hardware or software problems, internet connection problems or similar circumstances.
Delays, deletion of data, inability to deliver or save user settings, or any damages or loss of profit arising from the use of the Website or the inability to use it due to technical problems, interruption of service or similar circumstances.
Any damage caused by or otherwise related to access to, use of, or inability to use the Website. All information on the Website is provided in accordance with applicable Bulgarian legislation. Zographic Films does not guarantee that the Website will be completely immune from malicious attacks or unauthorised interference by third parties.
Users’ subjective assessment or interpretation of the accuracy, completeness or usefulness of the information and resources available on the Website.
The information contained on the Website, including its completeness and accuracy, or information contained on third-party websites to which the Website provides links.
Art. 6.
(1) Users shall indemnify Zographic Films against any damages, costs and third-party claims arising from a breach of these General Terms and Conditions and/or unauthorised use of the Website.
(2) In addition to paragraph 1, users shall indemnify Zographic Films and any affected third parties against damages and loss of profit suffered by them, including pecuniary sanctions, legal fees and other costs arising from claims brought by and/or compensation paid to third parties in connection with intellectual property materials that the user has made available to third parties, or has made available through the services provided by the Website, in violation of these General Terms and Conditions or applicable Bulgarian law.
Art. 7.
Zographic Films may change, suspend or discontinue any aspect, service or feature of the Website at any time, including, but not limited to, its content, availability and the equipment, software and/or hardware required for access or use.
Art. 8.
(1) Zographic Films reserves the right to amend or revise these General Terms and Conditions at any time.
(2) All amendments to these General Terms and Conditions shall be published on the Website.
(3) Amendments shall enter into force immediately upon publication.
(4) Users are responsible for reviewing these General Terms and Conditions before using the Website. By continuing to use the Website after amendments have been published, users are deemed to have accepted them.
Art. 9.
Any correspondence between Zographic Films and a user shall be made by means of written statements or messages, including registered letters with acknowledgement of receipt, e-mail, the clicking of a virtual button on the Website or other comparable means, provided that the relevant statement is technically recorded in a manner that allows it to be reproduced.
Art. 10.
If any provision of these General Terms and Conditions is found to be invalid or unenforceable, this shall not affect the validity of the remaining provisions. The invalid or unenforceable provision shall be replaced by the applicable mandatory provisions of law or, where appropriate, by established customary practice.
Art. 11.
Any matters not expressly regulated by these General Terms and Conditions shall be governed by the applicable legislation of the Republic of Bulgaria.
